Terms of Service
The deliveries, services and offers are made in accordance with our General Terms and Conditions in the version valid at the time of the order. Individual contract agreements have priority over general terms and conditions.
1. Conclusion of the contract / purchase

If the goods placed by us on DaWanda are provided with the Buy It Now option (fixed price), a contract for the purchase of the goods is concluded independently of the expiry of the offer time at the fixed price specified in the item description. The posting of the item description by us on DaWanda to carry out an buy-a-auction represents an offer to conclude a contract. The Buy It Now option can be exercised. To accept a Buy It Now offer, the customer must perform the following technical steps:

2. Choice of law
The law of the Federal Republic of Germany applies to the contractual relations between the contracting parties. Excluded from this choice of law are the mandatory consumer protection regulations of the country in which the customer has his habitual residence. The application of the UN Sales Convention (CSIG) is excluded.
3. Prices / shipping costs
The total price of the goods includes VAT of 19%. Furthermore, the total price includes shipping costs in the amount specified in the offer. Shipping costs consist of packaging material, working hours and shipping documents. No customs fees
All items are delivered within Germany and to Austria and the European foreign countries, The payment takes place at the choice of the buyer in advance (bank transfer or Paypal) The delivery takes place either by DHL, post office, UPS, Hermes, GLS or over a forwarding.
All prices are in € uro, any customs fees / taxes / taxes / other charges for shipments abroad are not taken into account, furthermore, the delivery is only up to the curb
Please pay your items immediately, because after 3 days you will receive a payment reminder, after 5 days a case will be opened automatically because of an unpaid item, at the latest after 10-15 days we will cancel the purchase and you as the buyer.
Of course, you can also make the payment later, except that you will automatically go through the above steps.
We do not offer combined payment, as we ship all items separately to avoid shipping damage.
4. Distance-related information
The instructions about your statutory right of withdrawal as a consumer, exceptions to the right of withdrawal, its premature extinction, the cancellation form, the consequences of withdrawal, eg. B. We do not provide customer service and provide no guarantees ourselves.
There is no out-of-court complaint or appeals procedure to which we are subject.

2. Contractual Text / Expression
The contract text is stored as a DaWanda website after conclusion of the contract for 90 days and can be viewed by you on DaWanda by entering the respective article number. You can also save the text of the contract yourself by using the function of your "Save as" browser to save the relevant website on your computer. The print function of your browser also gives you the option of printing the contract text.
We ourselves save as a seller after signing the contract and make it available to our customers on request. Anyone who wants to secure contract texts beyond or beyond the scope of the storage offered by DaWanda must arrange for this themselves.
3. Correction possibility
You can correct your entries at any time during the ordering process by selecting the "Back" button in the browser and then making the appropriate change. By closing the web browser, you can cancel the entire ordering process at any time
The language available for the conclusion of the contract is exclusively German.
5. Code of Conduct
In addition to the terms and conditions of the platform operator DaWanda, we have not subjected ourselves to any special code of conduct (rules and regulations).
There is a statutory right of defect for goods. The warranty for defects of the goods is 24 months for new goods according to the statutory provisions.
For used goods, the warranty period is 12 months. The warranty period begins from the delivery of the goods to the buyer.
However, it remains with the regular limitation period of 3 years, starting from the end of the year, in the
1. the claim has arisen and
2. the creditor should have gained knowledge of the circumstances giving rise to the claim and the person of the debtor or would have had to acquire them without gross negligence,
- when it comes to liability for damages resulting from injury to life, limb or health, which are based on a negligent or intentional breach of duty or a willful or negligent breach of duty of one of my vicarious agents
- if it concerns the liability for other damages, which are based on an intentional or grossly negligent breach of duty committed by me or on an intentional or grossly negligent breach of duty of one of my vicarious agents or
- in the case of liability for fraudulently concealed defects, claims arising from promises of guarantee or liability in accordance with mandatory statutory provisions, eg. B. according to the product liability law.
The two-year limitation period for recourse claims in accordance with §§ 478, 479 BGB remains unaffected.
The warranty does not cover normal wear or normal wear.
7. Retention of title
1. We reserve ownership of the delivered item until receipt of all payments under the purchase contract. If the buyer fails to fulfill his contractual obligations, in particular in the event of late payment, we are entitled to demand the delivered item or to cancel the purchase; the buyer is obliged in this case to return the object.
2. The buyer is obliged to notify us immediately in the event of seizure of the object of purchase or other relevant access or attempted access by third parties with respect to the object of purchase so that we can exercise our rights arising from the reservation of title.
All personal customer data collected and stored by us are used exclusively for the purpose of the purchase. The name and surname of the customer, the corresponding invoice and delivery address as well as a possibly stored phone number and email address are stored. The data collected will not be passed on to other third parties, with the exception of legally necessary measures (eg collection agency, lawyer, credit bureaus) and measures of transporting the goods, including the tracking of consignments.
The photos and the texts created by us are protected by copyright. The copying and publishing thereof (even in part) is gem. § 97 UrhG prosecuted under civil and criminal law.
10. Note on Battery Law (BattG)
If the offer includes batteries or batteries, you are legally obliged to dispose of used batteries or rechargeable batteries separately. Please hand it in at a municipal collection point or at the local retailer. You can return batteries and rechargeable batteries that you have received from us free of charge. Batteries that contain pollutants are marked with the crossed-out wheelie bin symbol and the chemical symbol of the pollutant (for example, "Cd" for cadmium, "Pb" for lead, "Hg" for mercury). You will also find these instructions in the accompanying documents of the consignment.
11. Transport damage
(1) If goods are delivered with obvious transport damages, please complain such errors immediately to the deliverer and please contact us as soon as possible. firstname.lastname@example.org
(2) The failure to make a complaint or contact has no consequences for your statutory warranty claims. However, they help us assert our own claims against the carrier or the transport insurer.
12. Other information
We do not reserve any items as this is not possible in our system.
Delivery time / delivery:
We strive to get each package shipped as soon as possible.
In general, Swiss Post needs 1-3 working days from shipment to delivery.
In individual cases, force majeure, strike, fault of subcontractors (lost, damaged) & suppliers for individual articles up to 3 months, the delivery time information may deviate from the given estimated delivery date.
In addition, a forwarding delivery must be delivered to you within 5 days of dispatch, otherwise storage costs will be incurred by the freight forwarder. The shipping company will only contact you once to inform you about the approximate date of delivery. If they are not available, the goods will be parked in the yard.
Where is the package?
The exact answer to this question knows only the post.
Normally you will receive an e-mail with the corresponding parcel number of your shipment after we have created a shipping order.
Using the link in the message, you can track the package on the Internet, so you can always see exactly where it is.
Please note that the so-called "tracking" is not immediately possible, this can take up to 1 day.
Please notify us immediately after the purchase if you want to pick up the item self, then we can cancel the shipping costs from the total amount, and deposit the costs specified in the offer for self-collectors. Only one processing fee will be charged to you then this processing fee is due per item, and in the respective item description the exact amount of the fee is visible. Generally it is possible to pick you up MO-FR 9-12 & 14-16. However, we ask you to call us at least 48 hours in advance and make an appointment. Then we can make sure that the desired article at the appropriate time in our stock in stock. Please note that we can only accept payments in cash. BEFORE BY PAYPAL / BANK TRANSFER. The entire collections of purchased items must be made within 10 days of purchase / availability. OTHERWISE, WE WILL CALCULATE STORAGE FEES FOR THE STORAGE OF ARTICLES IN THE AMOUNT OF AT LEAST € 10 PER QM2 AND DAY. In case of pickup you are responsible for the loading and packing of the products. There must be an appointment to pick up at least TWO DAYS in advance by phone.
Cancellation / Cancellation Purchase Agreement
Since only one-off pieces and handicrafts are sold, no substitute deliveries can be offered for any transport damage, loss of the item, delivery bottlenecks by suppliers, in which case rectification of damage claims are excluded.
